005.0010         QUALIFICATIONS TO BECOME CAREER EMPLOYEE

1.      GENERAL STATEMENT

The purpose of this policy is to set forth the rules governing the qualification of an employee as a career employee.

 

2.      DEFINITIONS

2.1      “Career Employee” means an employee of the district who, except as explained in section 2.1.1,  has been contracted by the District more than three consecutive successful years or who has obtained a reasonable expectation of continued contract employment based upon an agreement with the employee or the employee’s association, District practice, or policy. (UCA 53A-8-102)

2.1.1        As specified in Utah State Board Rule 277-503, school district specific competency-based license holders are at-will employees consistent with Utah Code 53A-8-106(5).

2.2      “Provisional Employee” means a person who has been contracted by the District less than three successful years and who is not a Career Employee as defined herein.  Provisional Employees have no expectation of continued employment beyond the end of the current contract term.  Provisional employees will be notified of non-renewal at least 60 days before the end of their contract period

2.2.1        Provisional status may be extended up to two additional years, if necessary, for a total of up to five years.

2.3  “Successful Year” to be included in determining whether or not a Provisional Employee has served three successful years to become a Career Employee, means for the year, the Provisional Employee:

2.3.1        is employed by the Uintah School District;

2.3.2        has received all satisfactory or greater evaluations during the course of the year;

2.3.3        has not received any formal letter of reprimand, notice of suspension, termination, retention on provisional status, referral to the Board of Education, non-renewal, or notice of other formal discipline to be placed in the Provisional Employee’s personnel file;

2.3.4        (if a teacher) has met all of the requirements for certification and is certified to teach in the areas assigned to teach; and;

2.3.5        has otherwise successfully performed in his or her duties and responsibilities.

 

3        QUALIFICATION AS A CAREER EMPLOYEE

3.1  A Provisional employee who has been contracted by the Uintah School District for more than three years becomes a Career Employee unless provisional status has been extended as described in section 2.2.1.  Time employed with a school district other than Uintah School District and time spent as an intern teacher is not included in determining whether or not a Provisional Employee has served three Successful Years to become a Career Employee.
