005.2100         DRUG FREE WORKPLACE

 

REPLACES AND REVISES POLICY 005.2100 DRUG FREE WORKPLACE (LAST APPROVED 8/28/07)

 

1.0              Drug Abuse

1.1              Uintah School District has a responsibility to maintain public trust and confidence by providing a safe school environment for students and a safe work place for employees. The District is committed to provide a drug-free, smoke-free, and alcohol-free workplace. Employees of the Uintah School District are expected to follow the federal, state, and local laws which prohibit distribution, manufacturing, and/or possession of alcohol, drugs, and tobacco at school or in any other school district location as defined below.

“School district location” means in any school district building and on any school district premises; on any school-owned vehicle or in any other school-approved vehicle used to transport students to and from school or school activities; off school property at any school-sponsored or school-approved activity, event or function, such as a field trip or athletic event, where students are under the jurisdiction of the school district; or during any period of time such employee is supervising students on behalf of the school district or otherwise engaged in school district business.

2.0              Violation

2.1              Violation of this policy may result in suspension, remediation, and/or termination.

2.2              In lieu of termination the district may make available, drug counseling, rehabilitation, and employee assistance programs involving trained professionals at the expense of the employee.

2.3              Penalties will be imposed within 30 days after conviction for drug abuse violations occurring in the workplace.

3.0              Components of a Drug-Free Workplace

The school board shall establish criteria for maintaining a drug-free workplace by publishing and distributing the following:

3.1              A statement notifying employees of each unlawful action that would result in their termination.

3.2              A pamphlet explaining the harmful physical and mental effects of drug abuse and how it hampers one’s productivity in order that each employee may fully understand the importance of their compliance with this policy. Such pamphlet will be distributed to all employees during a preschool staff meeting and will be provided to all new employees hired after said staff meeting under the provisions described in Section 3.4.

3.3              A statement describing the penalties to be imposed upon employees for drug abuse violations occurring in the workplace.

3.4              This information shall be communicated to employees by giving them a copy of the DRUG-FREE WORKPLACE POLICY and discussing it in an appropriate manner in a preschool staff meeting on an annual basis. All employees shall acknowledge receipt of this policy and related information by signing a copy of the “Knowledge of Policies and Procedures” form, which will remain on file throughout the year.

1.0              EMPLOYEE REQUIREMENTS

1.1              Abide by the employer’s drug-free policy.

1.2              Notify employer within five days should a violation occur.

1.3              Observance of this policy is a condition of employment. A violation shall subject the employee appropriate disciplinary action which may include termination.  Disciplinary action shall be taken in accordance with applicable Board policies.

2.0              EMPLOYER REQUIREMENTS

2.1              Agrees to sign and return to the Federal Funding Agency the applicable Certificate regarding drug-free workplace requirements.

2.2              Notify funding agency of any employee conviction within ten days of receiving such notice.

2.3              In lieu of termination, make available drug counseling, rehabilitation, and employee assistance programs involving trained professionals at the expense of the employee.

2.4              Make sincere efforts to continue to maintain a drug-free workplace.
