REVISES POLICY 010.0025 CONDUCT ON SCHOOL PREMISES (LAST APPROVED 11-2-93)

 

1.0  DISRUPTION OF CLASSES

1.1              No person shall be permitted, on school property or on public property within 500 feet of school property, to willfully disrupt, alone or in concert with others, the conduct of classes or other school activities.

1.2              Conduct which disrupts the educational activities of a school includes:

1.2.1        Emissions by any means of noise of an intensity which prevents or hinders classroom instruction.

1.2.2        Enticement or attempted enticement of students away from classes or other school activities which students are required to attend.

1.2.3        Prevention or attempted prevention of students from attending classes or other school activities which students are required to attend.

1.2.4        Entrance into a classroom -without consent of either the principal or teacher and either through acts of misconduct and/or use of loud or profane language causing disruption of class activities.

2.0  DEFINITIONS

2.1              For purposes of this provision, “school property” shall include the grounds upon which any public school is located, and any grounds or buildings used by District schools for assemblies or other school-sponsored activities.

2.2              For purposes of this provision, “public property” shall include any street, highway, alley, public park, or sidewalk.

3.0  DISRUPTION OF LAWFUL ASSEMBLY

3.1              No person(s) may willfully engage in disruptive activity or disrupt a lawful assembly on the property of any school in the District.

3.2              Disruptive activity includes:

3.2.1        Obstructing or restraining the passage of persons in an exit, entrance, or hallway of any building, or while on school property, without authorization from school administration.

3.2.2        Seizing control of any building or portion of a building for the purpose of interfering with any administrative, educational, research, or other authorized activity.

3.2.3        Preventing, attempting to prevent, or disrupting, by force or violence or the threat of violence, any lawful assembly authorized by the school administration.

3.3              A lawful assembly is disrupted when any person in attendance is rendered incapable or participating in the assembly due to the reasonable fear or use of force or violence.

4.0  FREE SPEECH

4.1              Nothing herein shall be construed to infringe upon any right of free speech or expression guaranteed by the Constitutions of the United States of the State of Utah.

5.0  LOITERING

5.1              Any person loitering on school property after being advised to leave by the person in charge shall be guilty of a misdemeanor and upon conviction shall be subject to a fine, as established by law.

5.2              For purposes of this provision, “school property” shall include the grounds of any public school and any grounds or buildings used for school-sponsored activities.

6.0  TRESPASSING

6.1              The Board or its authorized representative may refuse to allow persons having no legitimate business to enter on property under the Board’s control and may eject any undesirable person from the property on his refusal to leave peaceably on request. Identification may be required of any person on the property. Violation of this section is a class B misdemeanor. School officials may bar an individual from school property by serving a Notice of Barment. Any person found on school property after barment may be prosecuted as a trespasser.

7.0  INTOXICANTS AND ILLEGAL SUBSTANCES

7.1              No person(s) may possess any intoxicating beverage for consumption, sale, or distribution, or be under the influence of alcohol while on the grounds or in a building of any school in the District or while entering or inside any enclosure, field, or stadium where any athletic event sponsored or participated in by a school in the District is being held.

7.2              Possession or use of illegal drugs on school grounds is prohibited.

7.3              Smoking on school grounds is prohibited.

8.0  DANGEROUS MATERIALS

8.1              No person shall possess a weapon, explosives, flammable material, or other dangerous material on any school district property unless such possession has been approved by the responsible school administrator. Violation of this section is a class B misdemeanor unless a higher penalty is prescribed in Title 76, Utah Code Annotated.

9.0  MODIFIED PUBLIC FORUM

9.1              All school buildings have been designated as modified public forums after school hours. However, during school hours all school buildings are dedicated to the sole and exclusive purpose of providing education to school students then attending school.  No person visiting the schools shall have access to the schools unless express permission is granted as provided below.         

10.0          NOTICE TO SCHOOL PRINCIPAL AND PERMISSION TO ATTEND

10.1          All parents, guardians, or other persons having any business to conduct on school property during school hours must check into the school Principal’s office and obtain express permission from the Principal or other school administrator to be present on school premises during school hours. In the absence of express permission, all visitors to the school shall be deemed to be trespassers on school property and subject to immediate removal by the school district.
